I feel like I have been taken advantage of by my previous landlord in which I lived in a building for a year (last year) with numerous violations including:

-random repair men walking in my bedroom without knocking or notice
-not making repairs
-mold on walls
-no smoke detector/fire alarm
-landlord let a homeless man sleep in basement in exchange for maitenance work like painting etc
-rungs missing in fire escape
-main door broken for weeks on end, allowing anyone from the street to walk in to the building

she withheld my security deposit because of "cleaning the entire apartment" (which was never done, and attested by the current renters), and "storage fee" which she never informed me of, and "wall damage" which there is none and she never showed me what was "damaged."

i am so lost and have no idea what to do. im not trynig to sue for thousands, i just want my security deposit back... i am a poor college kid...

Yea take her to court, you be surprised how cheap u can get a lawyer for that kinda stuff, also if you go to a law library usually the librarian is very smart and can give you a lot of advice on how to do it yourself. We got Fed over and jerked around realy bad(claiming he never got security deposit when we had reciept, not providing necessities areed upon in lease, yada yada) by our last landlord and are in the process of sueing. Good luck, don't let peole dick you around like that, and dont let them do it to the next people ya know- good luck

I don't think there is much you can do about what was wrong while you were there. That's a non-issue at this point.

However your security deposit is a very big deal. In the lease, does it say anything about what the terms are when you leave regarding cleaning? Also, did you and the landlord do any kind of final walkthrough? Any photos of how it was when you moved and when you left? Was the reason your security deposit held given to you in writing or verbally?

Did you leave the place a dump?

Your best bet is to sue in small claims court for your security deposit back. If you have it in writing, or you believe the landlord would say that it was for cleaning in court, and then you can produce the current tenants saying the place was a dump when they took it, you might have a case. Of course that still means you left the place a dump, and the judge might not look favorably on that.

Consider this an expensive lesson to always:
1. Always know the terms of your lease or rental agreement
2. Do a walkthru with the landlord, with written notes when you take posession.
3. Do a walkthru with the landlord, with written notes when you turn posession back over to the landlord.
