My fiance is in ADC and filed for divorced last August to his wife in Sacramento. He was never served with any papers and dosen't know if she was either. how is he able to find out if they are divorced?

Ummm..I think I would remain unattached until your divorce is proven to be final, his divorce is proven to be final and HE'S free to be with you. You're going to wait six years for this guy? Please don't waste your time. Sounds like you're rebounding and just want someone to love, and to be loved. Life, love, commitment is a serious thing. Consider them all. Don't be needy or desperate. There's plenty of fish in the sea, don't tie yourself down to one inaccessible.

Most court filings and motions are a matter of public record and freely available for the asking. I am, admittedly, not familiar with the CA records availability, That being said, I would highly suggest that you personally place a request with the court clerk rather then to simply accept your fiance's statements regarding the status of his divorce proceedings. Many courts also make their records available on-line (most often for a relatively small fee per page.)

Your inquiry also begs the question, does your fiance have an attorney representing him? Or did he go "pro se?" (act and attempt to file as his own counsel.) If he does, then either he has a lousy attorney or he is being less then truthful to you.

IF your fiancee truly filed for divorce, his wife would've been served with the divorce papers. After she signed them and returned them to the courts, your fiancee would have received a notice from the courts stating that. If nothing in the divorce papers was to be contested and both parties wanted to go forward, a divorce decree would be issued by the court and each party would receive a copy. So it doesn't sound like your fiancee is yet divorced. He needs to contact the Clerk of Courts to see where he stands.

If they haven't gone to court, then the process hasn't started. He needs to call the clerk of court in the county that he filed to see if they even know about the papers. This isn't just some paper you fill out and it's done.

When a divorce is final, then he should get a judgement that is signed by both spouses and the court judge.

My guess is, this hasn't even started yet. Did he move? Did he tell the court where he moved to?

If he never signed divorce papers then it isn't final, but he could probably find out by going up to the court house and asking them if the papers were final yet.

I work for a law office you need to call the court that it was filed in and have the case number ready Just ask them if the divorce was finallized yet and if not what needs to be done... hope i helped

Only took about 4 months for my divorce to be final. He should receive his divorce decree. If you aren't sure that his wife was served...you should find out.

Go to the court were the divore was filed. They could give you all the info you need. Good luck!!

You sign a contract or something. Does he have a lawyer? They're expensive.

You could have him try and marry someone. If they have a problem getting married, then you'll know.
