My girlfriend has worked for the same company for nearly 3 years. In that time she has never had a review or a raise and has generally been mistreated. Her human resources department was shocked to discover this and she was told by her boss that she would get a review in a week. That was 3 weeks ago and now the company changed her boss and pretty much disolved her department. They then told her the review was going to be pushed out 2 weeks. Her coworker is currently on vacation and she's covering both jobs for two weeks. They told her they would give her a review when her coworker came back. They are now interviewing for new hires and based on the testing they are doing it sounds like it's for her department and a lot of employees there are telling her it looks like they are looking to fire someone in her department and that she should keep an eye out over her sholder. Can they fire her for asking for a raise/review? If they do can she persue a law suit? She has emails on some of this

The best thing she can do is look for another job, leave on good terms and give two weeks notice

Ohio is an at-will employment state meaning that the company can fire someone for any reason or no reason. Similarly, your girlfriend can quit for any reason or no reason. If she is fired through no fault of her own, she can file for unemployment compensation.

But the more practical thing to do--quit. She obviously hatesher job, has never had a review or a raise, has been generally mistreated. Line up some interviews, take a couple days vacation, go on the interviews, get a job, come back and give notice. That's how adults handle problems; they don't sue like petulant children.

The answer is yes, and in the 49 other states also. Unless she is a member of a union with a collective bargaining agreement or a contract to the contrary, or an employment contract (outside of a union) with specific reasons she can be fired, then there is no law which requires the employer to fire her ONLY for specific reasons.

They would not use the request for a raise as a reason for terminating her job. From what you say in your question, they would cite "reorganization" as the reason. That is not going to be successfully actionable in my opinion.

If that is the case, sure she can sue but the odds of her being successful are stacked against her.

They can fire you for any reason or no reason, so long as the reason isn't contrary to public policy (Age, gender, religion)

So, yes, they can absolutely fire you for asking for a raise.

No one to sue here, sorry.

And really, if the treat her like sh*t, why does she want to stay there??

i live in ohio. unless you have a contract we are an at will state. they can fire you for anything.
