They cannot garnish your wages from work. They can however, take funds from a joint bank account and a joint filed tax return. Do not put his name on your bank account and either file taxes separately or file the form called "injured spouse" if you do file jointly, that way they will not take your portion of the tax refund.

MA. may or may not have that law on the books few states do. However, you could seek your relief in a judgement from court, But personally I would start contacting people there, that's what you pay taxes for, their services... start here;
State Administration/Revenue: Child Support/Federal Parent Locator Service
P29 Child Support Enforcement Division (CSE)
Department of Revenue
100 Cambridge Street
Boston, MA 02114
Toll Free: 1-800-332-2733 (Nationwide)
TTY Toll Free: 1-800-255-5587 (Nationwide)

E-mail: www.cse.state.ma.us/feedback/GeneralInfo.asp
The Child Support Enforcement Division of the Department of Revenue provides a range of services to custodial parents or guardians of children under the age of 18 to help ensure that they receive financial support from absent parents. CSE helps locate non-custodial parents and legally establish a child's paternity. CSE also works to establish or modify child support orders. Once an order is established, CSE can collect and monitor child support payments, forward payments to the custodial parent, and enforce the order if the non-custodial parent fails to comply.
Finally, for legal purposes, I must state that in no way should this be construed to constitute legal advise.

given which you're interior the armed forces, i'm particularly constructive they have COs, or some thing like that, that can assist you out with your subject. i do no longer understand how the armed forces works, yet my husband (former Marine) says, they have depts. to assist out with your loved ones, that's the place you're able to ask them, what'll happen on your wages. My suggestion is on your to get your self a each year planner from Staples or workplace Depot-they are the purple diaries with the 12 months imprinted on the backbone of the e book, that proclaims customary diary. initiate documenting all visits, contacts, correspondence, and contact calls, besides receipts of what you're doing with the funds. do no longer initiate telling your loved ones/acquaintances what you're doing, besides as hers too. they do no longer could be understanding all the corporate, save your planner secured in a secure area. in case you're able to pass to court docket, whether in civilian or armed forces, you have stored your information, in no way throw it away, given which you in no way understand how long you will possibly be able to need this information. you would be shocked how mess will floor later on down the line. All, that's, is that your guy's ex can no longer stand the reality that he's with you and he's moved on along with his life. She's in simple terms being depressing, and wanting company, it particularly is all. You did no longer say how your stepchild is dealing with all of this? Is she siding along with her mom or staying out of the mess? do no longer provide into her whims ok? And confident, such as you, my husband's from PA and his ex's from NC. And confident, she additionally threatened him with new child help and the likes. All she is a narrative teller, suited mutually along with his daughter, that is unlucky. in any case, good luck on your subject.

You should check with a lawyer, however Massachusetts is not a community property state so your wages should not be subject to garnishment for a judgment against your spouse.

My advice is to never date let alone marry a man with children.
My girlfriend was in the same situation she is a nurse and married a guy with children after I warned her not to, and now his ex wife is getting a nice portion of her income.
Needless to say she is divorcing him after 2 years of marriage this has really torn their relationship apart.
Because he was so far behind in payments child support is taking so much of their money they are barely able to make their ends meet while she just bought herself a nice little luxury SUV

They cannot garnish your personal wages, it is not your obligation. They can only garnish his wages. If they are already garnishing your personal check , you need a lawyer. It is against the law.

Keep them in a bank account that he has no access to, and do not allow him to deposit money into it.
They can't take what's yours, but once it goes into an account he has power over, or his money is commingled with yours, it's fair game.
