My husbands roofing company was doing a three day roof job. They came back to work the second day and found that someone had stolen $600 worth of shingles off of the homeowners property. And you have to leave shingles out at a job b/c they are too heavy to move back and forth to the job. Who is responsible for the stolen shingles, the homeowner's insurance company or my husband???!!!

Your husbands insurance...since the homeowner has not signed off on the work and paid...the shingles did not belong to the homeowner....therfor his insurance will not pay for it

It depends on the contract.

More than likely, the risk of loss of materials not yet attached are on the subcontractor. The homeowner probably agreed to pay for a fully installed roof. Those are your husband's shingles until they are installed.

However, IF the homeowner bought the shingles and hired your husband as two separate transactions, the homeowner is stuck.

If he provided the shingles under his contract then he is . If supplied by the homeowner then they are . Regardless the 12 missing squares will need to be replaced and installed before anymore work can proceed on the home .

If there's a conflict...your husband would be responsible.
BUT...
The theft IS covered under the homeowners' insurance and they can make a claim if they wanted to.
Kinda like the stereo getting stolen from a friend's car at the house in the middle of the night. That would be covered too.

Your husband. The shingles obviously were not too heavy that they couldn't be stolen, thus your husband should have secured them.

Sorry that happened. But unless you can prove beyond a show of doubt that the homewner stole this property or allowed someone to steal this property, the person who acted with negligance in leaving it out is responsible.
