There is a stamp from the bank where it was cashed on the check. One of our signatures is a close match but not the other. The person who lives at the address now works for the bank the check was issued on. We have proof we were not in the country the day the check was cashed. How can we speed up this process? It has been almost 1yr.

I'd start with an attorney.

The first thing I'd need to know is who was holding that money and why. If they gave your money to the wrong person, they are still liable to you for it. The burden would be on them to prove that you received it.

A year is a long time. Call an attorney today.

First contact the company who issued the check and the bank who cashed it requesting a copy of the front and back of the check. The Bank employee who cashed it should have taken identification if the check was cashed by a non-customer. Have them confirm the signatures and if they are a bank they can actually review video tape of the day and time of transaction and get an actual visual on who cashed that item. Also be able to provide the proof you have that you were not in the area when the item/check was negotiated. I agree with filing a fraud claim and contacting an attorney.

Well, I would need more information. What you should do is talk with your bank about filing a fraud claim. Since one year has elapsed it's going to be pretty tough to get your money back. Failing that, you could talk with the local police department but again, the timing of the incident is probably going to work against you.

It's risky but you could go straight to the bank and tell them what you know as well.

If you've already been working with these parties and nothing has happened in a year, your best bet would be to start working your way up the chain of command. Be respectful and professional but be VERY assertive about requiring resolution ASAP. Good luck!

Yes you can get it traced from the bank as bank might be having a record of who has cashed it and when. Then you can contact that person or file a case against him with the help of those records of the bank.

need to get front And BACK copies of the check to trace who cashed in. go in person the branch it was cashed at and refuse to leave until the matter is resolved.
