My younger sister works at a daycare that is owned by a church. The do not pay overitme or provide any breaks during the day. She is only 19 and this is her first real job. She asked me if this was okay but I didn't know. At my job if you go over 40 hours in a week you get time and a half for every hour over 40. We also are intitled to a 15 minute break every 4 hours. She works 12 hours a day 5 days a week and 3 hours on Saturdays cleaning. We live in North Carolina. Is this right or is this illegal?

Ok so some of you say to report them. How do I do that? Give me a number or link if you can. All of the employees work this way and her boss told her it is fine because they are privately owned.

ISO Standard Any works exceed 40 hours per week are considered O.T. or in lieu of conversion to day off as a compensation.
Every 4 hours are entitled with 15 minutes of break.
Every 8 hours are provided with a hour of meal break.
if 12 hours work per days, it shall be 3 days of working with 3 off days not including Sunday otherwise O.T of 1.5 shall be paid accordingly and 2.0 shall be paid over 0000 hours.
A lot of pay regulations around the world have been abused to the employee cos of many loopholes yet everyone's governments are one eye corks and one eye opens only.
Whatever it is, the amount of pay u earn should be USD$8.50+++ per hours.

Many jobs are so easy you really don't need a break but you get them anyway. As far as a church goes her work is probably written off as a gift to the church by manipulating the books, as far as overtime a church can probably get away with it, but a quick call to the IRS will put them in their place if they are registered charity, if they aren't find another job, jobs are easy to find, and if I wasn't getting paid overtime I would walk out and turn them in for labor law violations!

If there are 6 employees or less then they don't have to pay over time. Also churches are tax exempt so that might have a part in the whole thing but all in all, less than 6 means they don't have to even pay minimum wage.

Sadly, religious institutions can be exempt from overtime laws. In some cases they don't even have to pay minimum wage. She should look over her employment agreement with the church and speak with her supervisor.
Also, if they have her on salary, not on an hourly wage there is no overtime.

Absolutely not!! It doesn't matter if a company is publicly traded or privately held, overtime laws work the same.

You might want to call the labor board in your state, there may be different laws for nonprofit organizations, but I would not think so. They are definitely in violation if the laws are the same. She may be able to sue them for back pay.
