I have a tree that gives out berries that look a lot like black berries. The birds eat them and do not die, do you think I could eat them too? Also, we are in zone three. What do you think this tree is?

No blackberries grow on a bush but Mulberries grow on a tree. Birds eat them and then when they poo it is blackberry colored ,, I would say you have a Mulberry Tree

The berries are probably mulberries. Mulberries grow on a tree and blackberries are on a bush. Mulberries kinda look like a tiny cluster of grapes and are a deep purple and almost black in color. Personally, I like mulberries, but they are a complete mess. Don't eat them until you make certain that they are edible.
