i didn't have a power of attorney so I couldn't get it out. I had to find my own place when he got back he got his own place and got the stuff out of storage. He wont give me anything!! None of the children's furniture my kids are sleeping on a air mattress.. He is giving me BAH but i need the furniture and stuff he is holding it hostage to try and force me to sign a seperation agreement. We live in NC u have to be seperated for a year before u can get a divorce.. Basically can he do this?? Is there anything I can do?? Besides go to his chain of command that isn't going to well.

As his wife, you shouldn't have needed a Power of Attorney to get things out of the storage unit when you separated.

As you are, in fact, separated, why not sign the separation agreement which could include a tentative division of property and child support?

It sounds like you just don't want to let go. That's understandable. But you've got now to think about putting your life back together and taking care of your kids.

Well from the sound of things - you'll want to get an attorney and KEEP A JOURNAL! Make notes of every stupid thing he does so you can take it and show the judge. Don't stoop to his level either. Take the high road for your kids. Try talking to the police, they can direct you in the right way (even if they can't do anything, they are usually willing to offer advice on what you can do).

Do you have a lawyer? You need a lawyer! It sounds like he has one. The lawyer can advise you on the property and separation agrement. You'll be able to get temporary child support during the wait for the divorce. Why wouldn't you want to divorce a creep like this? You and the kids will be better off not dealing with someone as cruel as your "husband."

No judge would let him get away with this but your going to have to get a divorce lawyer who knows the ins and outs of this kind of thing in North Carolina.

Take him to court, small claims should take care of it. Why not sign the seperation order? You are seperated and not planning on getting back together, right?

Get legal advice. Family court should help you protect your children. Do not let him bully you do not sign anything with out knowing your rights. Good luck be strong for your children.

Do NOT dump the children on him!! He can get custody if you do.

Tell him to give you the papers he wants you to sign and take them to an attorney to see if there is anything unreasonable in there. (There probably is.)

Bottom line: Kill him with kindness and he won't know what hit him.

you can get an attorney in your state that specializes in this area and they will tell you exactly what your rights are.

it doesn't cost a fortune for a consultation, and if you procede with a divorce you're going to need an attorney anyway.

do the right thing and go talk to one asap.

If you're not divorced, you're still married. Go to his house, get your stuff!!! IF he calls the cops on you, explain what is going on. If they wont help you, get a lawyer and take him to court.
