I've been working for a tech company for over 2 years and the protocal is after 3 failed test we will get terminated. Their tests are checking out our work. I failed on a minor issue that wouldnt prevent my job to be complete, however, it wasnt perfect. My concern is if I will be qualified for unemployment benifits if I happen to get fired. I have a family and can't afford to be jobless.

The only way that a company can fire you and request that your unemployment benefits be denied is if they fire you for just cause.. if it is written in a contract between you and the company that failing three tests is grounds for termination and denial of benefits then they would maybe have a case to request that your benefits be denied.. if that is not a written agreement..then I would have to say that you should be able to draw your benefits.. they may try to get them denied but you have the right to argue your position.. most likely, even if they try, they will not be able to get you disqualified..if they do fire you.. make them put in writing as to why you were terminated.. then take that to the unemployment office.. remember you will have the right to challange anything the company says.. it has to be a pretty tight case for them to win.. good luck

As passing these tests is a condition of employment and you have failed three of them, you are not eligible to receive any unemployment benefits from this company. My suggestion, find another job and begin immediately.
