My brother quit his job (car dealership/garage) and his boss came and took his van, which he claims they were $500 behind on payments. He was behind on payments, but he had permission to be from the boss, otherwise he would have made sure everything was paid. They weren't going to take it before he quit, can they take it now? Can they just come get it, is there any type of protacol they have to go through, like warning you ahead of time or anything like that?

He worked for this little garage that sells cars. He was buying a van off of them and has paid over half of the cost. And they just took it because he quit. Is that legal? Can he get his money back?

If you don't make your car payments when they are due,the company or person who you owe the money to can come and repossess the car. Since the vehicle actually belongs to the person who holds the loan,from the way it sounds that would be your brother's boss,they can come and get it anytime they chose with no warning. He cannot get his money back,in fact,when they sell the van,your brother will be responsible to make up the difference between what they sold it for and what is still owed on it,if there is any.
The company was probably lenient with him on his late payments while he worked there,but now that he is no longer an employee,they do not trust that they will get their money. Might be vindictive on their part,but they are perfectly in their right to do it.

Your question is full of holes, and not understandable.

1) what do you mean he was behind on payments? Did your brother owe money on the loan to get the van?

2) was the van a company van?

3) if it was a company van, then yes the boss can take it, since it dosn't belong to your brother.

Did they ever transfer title to his name? If so, they can't just take it. If not, it is still their van.
