About 4 years ago I was at a party with some people I worked with at the time and I was talking with some people outside when this guy that I had a few problems with at work came out of no where and picked me up (my waist was up to his shoulders, that's how high he picked me up) and then just threw me on the ground, basically body-slammed me. I really have no idea why he did it. I black-out for a split second and when I came to..I heard people saying "you could've killed her, is she dead?" Yeah, it was that bad. Anyways, I was crying so hard because of the pain and someone finally drove me home. I tried to sleep it off but by the morning it hurt so bad that I told my mom (since I was living with her at the time) and she took me to the ER. They ran x-rays and found out I had air pockets in my chest, bursed lung, and a small hint of blood in my urine. Well my question is can I go back and sue the people that lived there? He was a waiter and has no money!

I know that homes are supposed to have homeowners insurance and HAVE to protect those surrounding the house and those who come into the house. I looked it up! Anyways, if the same people are living in the house should I seek an attorney? The reason why is because I am still have extremely bad back pain from it and I couldn't afford insurance then and my insurance now doesn't cover Chiropractors. What should I do?

Statue of limitations has probably run out on that one, especially since you have failed to take action for 4 years. And if you have NO police report, you are pretty screwed

Generally the statute of limitations for tort injuries is 4 years - So you needto act fast if the date has not passed - that being said I don't thinkit is right of you to tryto sue the homeowner. Why do you think they areliable for the actions of this guy - by your own account he had problems with you before this happened - should the owners of the house have known that this guy would do something like that - It just seems like they were not negligent at all. It seems the person responsible is the guy who threw you - and you should go after him - just because he has no money does not make it right for you to sue the homeowner just becuase he has insurance. If the statutute of limitations has not passed you should sue the guy - but it will be tough - you will have to prove causation - whcih is tough after so much elapsed time

I dont think you can do much about it now, since it was 4 years ago. The same owners of the house might not even be there.

Did you report the incident to the police? Was he arrested for assault and battery? If not, you are out of luck.
