It's not illegal, it probably won't cause any harm, but it's not the best idea. If you use your ISP's DNS server and for some reason they switch, they'll send an e-mail telling you to change your connections settings (if your connection isn't configured to automatically obtain the settings from your ISP when you connect).
If you use the DNS server of a different ISP and they switch, you won't get any warning and you'll effectively get the rug yanked out from under you where your connection settings are concerned. Since you're not a paying customer of that ISP, they're not under any obligation to inform you ahead of time of any changes they make.
The best idea would be to use the DNS server your own ISP recommends. But if you choose to use another one, make sure you have your ISP's recommended DNS server (or connection settings) written down in case something happens with the other ISP's DNS server.

It's not illegal- sometimes you even get better results (if your new ISPs DNS servers are unreliable or slow)
But the downside is that your old ISP may change the address of it's DNS servers at some point, and you won't know since you're no longer getting their system e-mails.

It is perfectly fine. We have client with other ISP's and I use our DNS servers for their connections. I feel I have better management on my own and I don't have to wait for some other company to fix a DNS issue. I just fix it myself

Seems like if the server "figured out" that you didn't suscribe to the particlar ISP it would start refusing your connection. The thing is, even if it were illegal, it probably would just be passed off as an honest mistake on your part and, as I said, the connection would just be refused.
