I have three years left to run on my under-pining/foundation guarantee, large cracks are appearing in my house . I have tried to contact the company who did the work and gave me the guarantee but they don't seem to exist anymore. Is my guarantee null and void. Is there a governing body who looks after this sort of thing? How can you issue a 10yr guarantee and dissapear? sorry to be niave but that means guarantees are worthless! Any legal/practical advice would be welcome.

Any guarantee is only as good as the firm which issued same. If the firm is defunct or bankrupt, you are probably on your own. When you deal with large established firms (Maytag, Whirlpool, etc.) you can pretty much expect that they will continue to be around for awhile. You do not say who the contractor was, but I venture it was easy for him to give a ten year guarantee and retire in the Bahamas somewhere.

If the company is out of business, you have no recourse. Unfortunately, this happens too often.

There was a pest control business in my area that offered a great deal on treating homes for termites with a 5 year guarantee. They were doing a brisk business for awhile. Then they were out of business. Probably at the Bahamas too.
