Sell the house, because he can't afford to Buy you out??(because he has a high debt that he owes). What happens when one wants to sell and the other doesn't, but yet you want a Divorce??

To Siva: He's not in trouble and if he won a lottery, It wouldn't make a difference, also the Divorce is kind of mutual. No kids involved! I don't believe that astrology will be the solution, so please don't waste your time on that, Thanx anyways though!

In cases like this. The judge orders half of the value. If he can't come up with the money. He has to sell the house and give you half of the profits.

This question is rather complicated as many things come into play in the decision. An out of court mutual decision is usually desirable but in most cases, divorce lawyers and a judge come into play. As you've left key information out (are either of you dependant upon the other's income, what were the reasons for wanting the divorce, are there children or custody disputes etc.), it's impossible to give a more pinpoint answer, especially since this question comes pre-divorce. At this time, I would suggest speaking with a lawyer, or divorce lawyer if you have the resources. Why did you marry him? When you married him did you know that you are going to divorce him when he is in trouble? How long you have been married and have you children?

If he won a lottery and pay all the debts will you forget about the divorce and enjoy his money?

Why do you want divorce and he doesn't? How do you know that after the divorce your life won't ber worse? Did you ever seperated from him and lived alone for a while? Do you know anyone who is divorced? Do you know how painful it is to go through the divorce process? The lawyers will make you to become an enemy of your husband! Do you want that to happen?

Well,
You are entitled to 1/2 the house if you have children that are under age the judge can award the house to you and he will have to find another place to live... If you want to sell then your Lawyer can file for a lien on the home and you get your money when the house sells. If you have been Married for 10 years or more than you are also entitled to his Social Sercurity Income when he retires, deciced, and so on...
you are also entitled to any assets of his money 401k, death, stocks, Cars exct. You can file for Allamony and childsupport if you have children too.

Possession of the house, or the liquidation of the assests from the house can be a part of the final divorce degree. It needs to be negotiated out between the lawyers representing you and the judge making the dovirce decree

I think it's something you would want to take up with an attorney. Was the debt that he is carrying mutual? If so, then maybe the best option is to sell then payoff the debt. Best of luck to you.

The courts can order him to pay you out over time or................you can have the courts put a lean on the home so after time when he does sell (even if it increases in value) you will be sent a check before he gets any money. Make the courts fight it out for you girl.

leave that decision up to the judge sweetie. that's what he get paid for--making those wonderful decisions:) I mean lay the basics out for the Judge so as to eliminate any questions and go for it!!!

He will come up with a manner in which you will get what it soming to you from the soon to be ex--Fear not you'll get yours one way or another!!

If you have reached in impasse then this is where your attorney earns his money. You should be able to seek a court directed course of events.

You can force the sell if that is what you want...or you can reach another agreement.
