My spouce is willing to sign his name of the title of our married home. We are seperated, not divorced.
How would a person go about making that change? Do you have to be divorced in order for it to be allowed?

There is no loan on our mobile home. He wants to do this so I in turn can get a loan against the home, use that money to pay off a truck loan I have. And then sign the truck over to him. He has the truck now. I have been paying for it and the insurance.

He can change the title with a Quit Claim Deed, but what about the loan? Do you own this home? If you don't, you may need to refinance the house in your name only, as well. Double check with an attorney (which you should have for the Quit Claim Deed anyway). Best of luck

Update: Then a Quit Claim Deed should do it. I believe you still have to go through an attorney.

Nope you don't have to be divorced...This is how we did it...my Now X, refinanced to get the house out of my name...I had to sign paper work releasing the equity to him (if you are doing so...if not then they owe you atleast 1/2) then I signed a statement that if he should ever sell the home they could change the title without further notification to me. Meaning the title would continue to have my name on it until it was sold...but they wouldn't need my signature again later on if me X should sell.

You first have to retain a lawyer, if your separated wife agrees to sign over her half of the house, a simple cheque from the bank in the amoun of the agreed upon settlement will close the issue. The other details (separation agreement, land transfer papers, etc.) can all be done in completion without worries by your lawyer
