Now the package is probably lost because it's been 7 days already and I shipped it via USPS priority mail (NY-->ALASKA) I don't know if it takes longer to Alaska, but 7 days seems kind of long.
In the EBAY auction I did offer insurance and they did not buy it. Am I still liable for the loss?

No, they should have purchased the insurance. All you can do is produce a receipt of when and how you shipped it and leave it at that.

In a more general sense...

When a product is purchased...it always should be specified when the exchange occurs.

Is if FOB THEIR DOCK
or FOB YOUR DOCK

That means...do they take possession when it is picked up or when it is delivered.

(FOB = Freight on board)

While is should be specified, typically, it can be inferred when possession is taken by who pays for shipping. If they control the shipping process(i.e. pay for it and chose the shipper)...they take possession when it is picked up. If you control the shipping process, they take possession when it is delivered.

Frankly, it shouldn't be up to EBAY. It should be specified in the sale and allowed to vary between different buyers and sellers.

If it were not clear where the purchase occurs, I would not specify the shipper, not pay for shipping, and leave all shipping responsibilties up to the buyer. Therefore, it's usually best to just include a disclaimer about shipping responsibilities for clarity.

For you to choose the shipper and yet offer insurance creates a conflict. It is difficult to hold a buyer responsible for a lost shipment when you chose the shipping company. Yet, they chose not to insure it.

Again, this is business in-general.

The only way that this will be different specifically on E-Bay is if there are disclaimers or general rules on e-Bay that specify when possession occurs...and that everybody using e-bay agrees to these rules.

Not if it clearly states in your description that you are not responsible for lost packages in the mail.

I have a store, and I clearly state that if they don't take insurance we are not responsible for lost or damaged items.

It may take a little bit longer to get to Alaska, keep in touch with the buyer and tell them to give it another 4-5 days.

If the package does not get there within two weeks, and you didn't state in your description about lost items, you probably will have to refund them and take the loss.

I learned the hard way.

If you can document the following things:

a) you offered insurance
b) they declined it
c) you did ship the package to the right coordinates

then they are responsible.

I'm guessing it will take longer than 7 days but you can call your post office and ask them. If it is lost and they didn't take the insurance it is their problem not yours.

1. Check with terms on EBAY

2. Check with terms of the courier you used. (it's in the back of the airway bill piece of paper or whatever receipt they gave you.)

3. In my opinion, 7 days ... it's still early
