he wants to move to spain within the next 2-5 years. the accusation as not gone any further than the polce questioning as the girl is scared of what her brother will do. The accusation also appears on an advanced disclosure when he applied for youth club at local church working with young chidren.
Will this come up in the questions when he applies to move to spain?

Well certainly anything he's been convicted of would come up, but anything he's simply under suspicion of should not.

That being said, if he's part of an on-going investigation the local police may not allow him to leave the state until their investigation is complete.

If he really did rape his own 12 year old sister, then he needs psychiatric help, and no disrespect to the mental health system in Spain, but that's probably best handled in his own country.

If you're close to him, you should encourage him to get help before other innocent children get hurt.

In my opinion, now that you know of this, you now have an obligation to act in his own best interest, even if that means being convicted of this and serving time in a correctional facility or mental health facility.

You should also inform your area police of your in-laws intended escape. Raping of a minor and a vulnerable younger sister is bestial and despicable and should not go unpunished under any circumstance.

Movement between EU countries does not require permission or a visa from member states. The issue here would not be whether he could move to Spain, but whether the country will get hold of this information.

At present, I don't believe that police files are transferred between countries like that (most police forces within the UK don't even speak to each other). However, if anything were to come of the accusation, the police in the UK can apply to extradite him for trial.

If the case is still being investigated, it would inadvisable to move at the moment. Wait until the complete outcome has been reached - remember, the girl is not the one who would be pressing charges, that would be the CPS and they can proceed with or without a victim's permission.

Probably will come up as the latest round of negotiations with the EU require all police data and files to be available to all other EU police forces. So I don't think he will be able to hide these offences from the Spanish authorities. I don't think they will want him.

Accused is the key word here! Did he do any time? Did he do it?...If so, maybe he needs to go to Iraq and not Spain!!!!

Sure he can move to spain if spain will take him. However, he'd have to look over his shoulder the whole time for "Dog" the bounty hunter!!!!!!!!!!!!!!!

if he's guilty, he should be sent down for the rest of his life, if not then the police will not pursue the matter, but don't you think its a bit worrying that his sister is afraid of him, and can you believe him ? I would be concerned if i heard complaints about one of my relatives for raping his little sister !!!
