A couple of months ago, my poor little Rover Metro broke down on the motorway with steam coming out of the engine. RAC towed me to a garage where they couldn't actually find out what was wrong with it. They thought it was the thermostat and changed that but then thought the head gasket could have gone and basically after getting a electric expert in, they concluded to me that it was pretty much beyond repair and would be cheaper to scrap than to repair. So - after much heartache (first car), I signed the V5 for them to scrap it. However now, my husband walked past the garage today and it's outside with a new tax disc on it. Surely they can't do this can they?
Have I got a leg to stand on to get it back??
My husband is going over there after work to see what they say.
Have I been had?

the problem is that you have scrapped the car. the garage can re register it again. All that was wrong with the car was the radiator had blown. I would call the police and see what you can do don't confront the mechanics it will make it worse. Unfortunately there is not much you can do because you have signed a document to say that you don't want it any more.

You have been had, i would get the police involved, if not the trading standards people at the very least, phone the d.v.l.a, and mke the enquiry about the new owner they might not disclose this, but explain that you sined the v5 stating the car was scrapped, the garage then would have to re-register that car, if you have the money availiable do a credit search on the car reg, if this does not show that this car is a salvage car you have been had, name and shame the garage big time, and goe for compensation.

You've been had I have to say 99% sure, it seems universal that garages are over-represented businesses when it comes to screwing people over if you are the slightest clueless about cars

When a car boils, yes it can be serious damage but not scrap-the-car-right-away serious. I worst case, the cylinder head can become slightly bent because of the heat from the boil,and start leaking.. but in most cases another cylinderhead can be fitted(from another used car of the same model) OR the head can be grinded level again, so it can be flush mounted back on the engine...

If I was your husband, I would be taking this VERY personally and I would be going round there and coming back with your car, and hanging over the rear view mirror wouldn't be a pair of furry dice neither, nope, it would be a pair of furry b#ll@cks which I would have removed from the sh@tbag who had ripped you off in the first place.

Their actions are tantamount to obtaining goods by deception and is against the law. They told you your car couldn't be repaired economically, you believed them in their capacity as professional mechanics, you signed it over to them for scrapping as they advised you to do, and they then repaired what was probably just a burst radiator or a simple head gasket repair.

Go to the police.

You have a case.

There is, of course another way, which I favour, and which would make you feel better. If you would like me to mail it to you (don't worry its nothing unlawful!!) then just let me know.

You scrapped the car based on the information given to you by the garage, as the car is for sale the information was at best wrong and at worst they obtained the car by lying about the true nature of the repairs needed.
That is obtaining goods by deception and is illegal.
Go to the police or sue them.

It looks like you've been had. In the USA such cars have a "salvage" or parts-only title. I'd notify the police and the motor vehicle department.

Yes but prove that the cooling fan fuse fixed it. They will say it took a new motor and 1,000 pounds euros to fix it and you signed it over. That is how the shop owner gets newer cars.

If they agreed that it was to be scrapped and they have instead repaired it and are now selling it then they have broken various laws, such as receiving goods by deception and fraud. To put it simply, it is theft by deceiving.

Sounds like they conned you! not much you can do about it now, Just let everyone know what they did! word soon gets around and a bad reputation is hard to get rid of

i would say you have been had....... surely they should have given you some compensation if they were going to rebuild the car...

no dount they have had to spend a fair amount of money on the repairs but still... it cant be right!

Confront them and see what they say or call the dvla and see what they say.
