His boss tells him how crappy of job he does and just puts him down

He can find another job/line of work as it doesn't sound like he is doing well at this one. A supervisor has every right to enforce any and all company policies and procedures, which your brother may be interpreting as "verbal harassment".

If he does and the trend continues, it is not a problem with the management of where he works, it is due to his work and attitude.

A really good manager will try to find an employees strength and exploit it, but as long as the manager is not treating your brother the way he is due to an EEOC protected category and their is the same pattern with other employees in the same category, there is no case.

Depends on the harrassment and his situation. If he can, and he knows it would hurt the boss, quit. If the harrassment warrants, threaten a lawsuit. You should be more direct with a lawyer before doing that, though.
