Usually, jurisdiction in custody cases is determined by where the children have been residing for the last year. However, if the children were moved since seperation, especially without permission of the other parent, a request for change of venue can be filed to have jurisdiction placed where they last resided.

As to joint physical custody, it would not apply. The children cannot attend two schools. There can still be joint legal custody, which would mean both parents would have to consult the other for major decisions. If she moved the children to Canada, your brother can request that she be required to pay for visitation expenses and/or have his child support reduced to reflect the cost of visitation. If he moved away from the children, he may still be able to have child support reduced but it is unlikely the court will grant it.

Unless the divorce was in the US and the court retained jurisdiction for custody issues, it's going to be an uphill fight just to get valid service on the mother.
