my friend who is 17 lit up in his car while pulling out of school and theres a frickin traffic cop at the intersection once your out and it was clear that he was smoking and the cop was looking straight at him but nothing happened so im guessing its not a big deal? i mean what EXACTLY can they do lets say im 17 and u have to be 18 to buy but i got em anyway and im smoking one past a cop, what EXACTLY can he do. take my pack? take me home? can i refuse? what will happen? does he even have to do anything?

He could take them, and more than likely he would just report it to your parents.He could by law charge you with possessing tobacco products underage, but most likely that would be a waste of the courts time and money so they don't do that often(unless they decide to be a dick). Buying them poses a bigger risk to you as far as getting arrested goes. As far as refusing, that is a misdemeanor unto itself so I would really just say, let the $3.00 pack of ciggs go man. It all really depends upon the cop and how cooperative you are with them.

He can give you a ticket, take the smokes away from you and even ticket the establishment where you got them. Don't have to but then they don't have to ticket you for speeding, drinking while driving or anything else either. It is an option they each one have. any kid your age that smokes is being really stupid as it is going to kill you sooner or later. Best to stop now as it is not cool as most think. Better not to than to wind up with lung cancer and/or all sorts of breathing problems later. That would be the smart way to go.

I guess it depends on where you are. The laws must be different in every state. My grand-daughter is 15 and got caught smoking on the street. She was given a ticket that cost $265. They did take that pack of cigarettes, but you know it hasnt stopped her from smoking.

Depends on the state. In Massachusetts for example, you can't sell or buy if you're minor, or if you're an adult, you can't give a minor cigarettes; but they dont specifically say its illegal for a minor to smoke it..

In Michigan the officer will destroy the cigarettes and you will get a ticket. If this differs in other states I'm not sure.

if its a real cop he can take your smokes and give you a ticket. dont be a dick and hopefully he wont be either.
