I have a friend, in Wisconsin, who has just separated from her husband. Her car is in his name, due to credit issues, and he came and took her car without her knowledge & won't tell her where it is. ALL of her VITAL personal possessions are still in the vehicle..ie: wallet (including D.L. & all her money). What can she do to recover her belongings?

She can file a small claims for the property through the local court system in your jurisdiction.

If your friend has not yet filed for divorce...do so...and bring this issue up before the court!

As for the vehicle...even if it's in his name...the laws of the state may state that the vehicle is both parties and not just his. A local attorney can advise you better.

Bring a proceeding of replevin to get the possessions and the car. In the meantime, report the credit cards as stolen and get them re-issued. File a police report on the theft (the D/L is a credential of identity, taking and withholding which is potentially a federal crime. And file the divorce proceeding now, it's not like he wants a reconciliation, does he.

This is not a repossession from the bank. If the car is in his name nothing she can do about it. He just took his car. As far as her personal belongings she has to call the police to report that. She must have some kind of a proof thought. What do you mean all the money she had?
