My close cousin is getting evicted. She has always paid reant on time and such... she has a 7 days notice, landlord says there are too many issues with vandilisim and that they don't take care of the apartment... the truth is, that their water has been shut off for 3 days now (the water is included in rent payment) and it seems to be that people are trying to break into their apartment? Is there a website that shows publicly the rules and/or guidelines to being a tenant in an apartment, and do they vary where you live? She lives in Kaukauna, WI. Anything would help tremendously. Thank you.

As Acermill says, if you don't pay water, in many jusrisdictions, the property owner becomes liable if you move.

However, since the water in this case is part of the rent and IF the rent was paid in full and timely, I don't see how he can turn it off until legally evicted.

The police will not get involved in this, it is a civil matter. She could potentially sue.

The whole thing sounds dicey, if I was this landlord and it was a month to month tenancy, I put her out out at the end of the month with 30/20 (depends on the state) days notice. He maybe asking for more hassle than he knows, if she knows what she is doing.

Maybe the landlord is a rookie.

I would like to first state this that comes directly from the tenant/landlord book.
The landlord is responsible for making any repairs that are necessary comply with local housing codes and to keep the premises safe. If the landlord refuses to repair major building defects, you may report the defect to your local building or health inspector. The landlord may not retaliate by evicting you.

That being said, the landlord still may decide to evict. However, if this goes to court, all I may suggest is that landlord better have solid proof that your cousin is doing the vandalism. Contrary to what some people believe, most judges will only say it's a he said she said issue.

In Wisconsin, she can be evicted for any reason the landlord chooses, or for no reason at all. If she is on a month-to-month tenancy, even with no violation of the lease, she can be given a thirty day notice that her tenancy is ended, and she will have to move. If she does not move, the landlord can have her legally evicted and put out on the street.

Spadezgurl is incorrect. In Wisconsin, unpaid water bills are added to property taxes if unpaid. I operate residential rentals in Wisconsin, and I HAVE had the water shut off to tenants to who are not paying their water bills. There is no law preventing this.

if her landlord shut off her water ses hould call the police, they will force them to turn it back on. they have no right to interfer with their utilities until they have a court ordered eviction. must serve tenants with 30 days notice to vacate. if they still dont vacate then they must go to court and legally evict you. they cannot be asked to leave until there is a court ordered eviction. tell ur cousoin to call the police if she has no runnign water they will force the landlord to turn it back on and arrest him for violating their tenant rights.
