I am 67. My father just passed away at 98. All through my life there have been mixups because of the same names. These included the IRS, car insurance, dentists, physicians, social security, Medicare, etc. etc. It has been a nightmare straightening out all the paper work due to all the mix-ups. Even now that he is gone, I am still trying to fix mixups on our Blue Cross and Medicare. I did not name any of my sons after me in order to save them from this problem. Having a different middle name did not help. Save your son from years of future misery by giving him a different first name if it is not too late.

My dad and his dad both have the exact same name, so my grandpa is Jim Sr. and my dad is Jim Jr. When my brother was born, my mom wanted to name him after a city that her family is from, my dad's mom wanted him to be called by my mom's maiden name (it's masculine), and my dad said "You all can name him whatever you want, I'm calling him Jimmy!" So, in the end my brother got the first name James and two middle names (the city and my mom's maiden name). My mom thought it would just be confusing, but it really hasn't been. Jimmy was always so proud to have the same name as my dad, and he always wanted to do everything just like him and our grandpa because the three of them were "the Jims." Now he's an adult, but when people call our house they still specify whether they want "Big Jim" (my dad) or "Little Jim." It's not confusing at all.
I say, leave the boy's birth certificate alone and call him Nicholas if you want to call him Nicholas and call him Robby if you want to call him Robby. Why can't he be Robby forever? Are you worried about it being confusing? My brother goes by Jimmy at home and by Jim with all of his friends. One of my best friends, Dan, is known as Danny to his whole family. I also have two male friends who were named after relatives and who go by their middle names to avoid confusion. It's not uncommon.

Just keep it the way it is. There are many men that share a name with their daddy! Robert is a great name because there are a lot of nick names you can choose from. If he is Robby now at some point I am sure it will be changed to Rob!

My middle name is my father's middle name (which was his father's first name, his father's middle name, his mother's middle name, her father's middle name, and his grandmother's maiden name).
My dad's cousins tend to be Juniors, but with unique middle names - we call them by their middle names (often, their mother's maiden names). Not too confusing, actually. My grandfather used his middle name, since his first name was what his father went by.
So, call Robert Jr Nick. Sounds like a great solution. Don't bother to go through the legal name change.

My brother was James and my dad was Jim (also James)....
It was only confusing when my brother got phone calls and they ask for Jim but we could usually guess who they really wanted :) His good friends nicked named him Jimmy James for phone purposes.
