pay will i go to jail after 3 years

i am going to pay but i need more than 35 days im in kansas and the letter came from minnesota

what TYPE of attorney? Is this a court summons or on the attorney's letterhead. I suggest you answer the question after reading the letter.

And in what state did this occur?

That is NOT what I asked. The specific question was were was the debt made? It doesn't really matter where the letter came from or where you live now but in what state were you living when you made the debt.

For the moment I'm going to assume Minnesota.

Therefore, the statute of limitations is, Except where the Uniform Commercial Code otherwise prescribes, actions based on a contract or other obligation, express or implied, must be brought within 6 years after the cause of action occurred (Chapter 541).

If they have obtained a judgement against you regarding the check, then the SOL is 10 years.

You need to make arrangements to pay this debt as it will stay with you for a long time.

Generally speaking you can not be put in jail for owing someone money. (The big exception to this is if it's the government you owe money to.) What he can do is take you to court to force you to pay. I do not know off hand if he can file a credit report on you if it was a bad check or not.

Of course (as the others have said) it's best to pay up if you do owe the money. If you can't afford it, try talking to them about setting up a payment plan. People can be reasonable and understanding if you give them the chance, and they would rather get payed in installments rather than not at all.

If you owe the money for the check then pay it. You owe it, pay it and you won't go to jail.

personal cheques are only good for 6 months from the date they are made payable for, therefore if they tried to cash it after that and you never knew about it, they can't really do anything to you..... at least i'm pretty sure they can't
