Well, for one thing, the visitation is for the husband not the new wife, so why is she taking the son for three weeks to Canada without his father? Ask the father that. That just doesn't make sense. From what I have seen of 10 year old boys, none of them appear to like to bathe or change their clothes so it would have to be something else more serious to trigger the alarm bells for the system to step in and do something about the call. As for the legal part of it, you'd have to prove that she deliberatly filed misleading or false charges, which would be hard to do. Besides, after telling the new wife that her son won't be going to Canada without his father should be revenge enough, it's what I would do.

It's not illegal. Child protecitve services will look into the claim and either find the mom guilty of neglect or state that the claim was unfounded. If she continues to make false claims that are proven to be unjustified, then your friend could probably sue for harrassment (might be hard though) but it's not illegal to try to protect a child (even if that isn't the motiviation behind the claim).

That is what is wrong with child services. They are to bust dealing with false claims that they can't deal with true cases.
Why is her son going to be with the new wife 3 weeks before the father gets there? I would only allow my son to go with his father.

It is illegal to abuse the law. However, proving it will be difficult. The new wife is just being vindictive, and to be honest, IT'S NONE OF HER BUSINESS! She (the new wife) stuck her nose in where it didn't belong - She needs to mind her own business! The child is 10 years old and can speak for himself if he is unhappy with something.
It's sad because the child is the one that is now being put in the middle because of the new wife's jealousy issues and he is the one that's being hurt. New wives can be a pain in the ***.

It is definitely illegal (and heartless) to turn someone in for something they KNOW is not true but I'm not sure how you would prove that she did that intentionally though.
