As far as I know it's legal, like spam. I usually call the toll free number that they have on the bottom for fax number removal and the amount of these annoying faxes have decreased considerably.

They haven't passed a bill yet, but fax machines are basically phone numbers as you know. You could try putting the number on the National Do Not Call Registry, but since that is for voice, I doubt it would work.
Just continue to toss the useless faxes into the 'circular file' !

My fax paper costs me money.
My fax machine costs me money to operate.
My office space costs me money to use.
My office is subject to enough noise pollution without soliciting faxes being added.
When anyone tries to solicit my business via MY fax machine, they are immediately eliminated from my list of people I will ever do business with in the future!

I used to work at a place where we sent out ads via fax. We got quite a bit of flack from some people, but if you proceed to remove their fax number from your list, usually things are ok.
if they ask you to remove their number and you continue to fax them they can go as far as to press charges, if I remember correctly

In 2003, legislation was passed requiring businesses to get permission for faxing to their prospective customers. i believe it actually went into effect in 04. I'll have to go and look back through my files. i went ahead and got permission from my existing customers(in writing) anyways to fax to them their invoices, statements, prints and etc. just to cover all of my bases. Plus i believe it shows respect for them by doing this.
