Well without a court order you might not have a good chance of seeing him this week. Use this time to go immediately to a lawyer and get the ball rolling on a custody agreement. You can probably get a temporary order pretty quickly so you can see him soon but you definitely need those court documents so if this comes up in the future you can simply call the police and let them handle it.
Sorry this is happening. I have an ex that is sometimes unreasonable and am glad on many occasions that we have the court orders to fall back on when we can't reach an agreement on our own.

Regardless of unwritten custody you have more rights as a mother than the father since majority of the time he is in your custody. If the father is just wanting more time talk to him about it, if he is just being a jerk and causing problems then go to the police and let them know he is refusing to give the child back. This can fall under kidnapping if he still refuses to give the child back.

Get a lawyer and bring this too court like you should have done to begin with.By the way not advocating this but my friend was in similar situation with no court papers she went over to her ex's house and took her child back literally.They could not charge her with kidnapping because its her child!no court papers were filed!Other than that ask your lawyer for other options?You probably need a court oder to see him again or at least a temporary one to see him this week.P.S never assume the ex.will play fair you need to protect yourself in court as well as your son!ask the police if they can help?

Well, you are going to have to. If he doesn't give your son back, there isn't anything that you can do. File for custody ASAP and see about getting primary temporary custody until the custody hearing is over. That is what my boyfriend had done in his divorce. His ex did the same thing.

Yes. Get a lawyer ASAP. You MUST have a custody agreement and visitation schedule in place or this will be a constant problem. I cannot believe you haven't done this yet for your and your son's protection. NEVER count on an ex to play fair when it comes to children. sad - but true.

you need to get a lawyer now and get the joint custody started. or if he is going to do that again (probably would you know ) then go for only visitation for him with you having full custody. but get a lawyers advice for the law in your area, so you will know what to do and your rights are protected in every step.

Get an attorney and call the cops that might even be considered kidnapping if he won't let you see him or have any contact with him.
