I am sueing my boss, who has refused to pay for my hours and phone bills. It is about 1400.00 I have documenatation on, and he has acknowledged in emails and phone conversations that he owes me the money. My question is can I sue for stress and if so how much. Becuase there has been a lot of stress involeded in this.

unlikly, unless you can put your stress on a meter, and prove it....not in small claims..........

I don't think so in Small Claims Court. They will limit you to your $1400.00. If you feel you need to sue for stress and all that-you'll have to go to a regular court.

Generally, for any amount that isnt purely quantitative, like your phone bill, is determined by the judge/arbitrator. Things like stress, pain and suffering, mental anguish, are all very qualitative and relative, so there is no real, definitive answer -- maybe throw out an amount you think would be sufficient, and see what the courts say.

small claims court is for money damages. The stress, if any, is not compensible under your state statutes.

You cannot ask for punitive damages (stress) in small claims court.
