Only if he is on the Mortgage and it is decreed in the divorce settlement; otherwise, it is your responsibility.

If you have never been married, the only amount your are entitled to is child support determined by a formula depending on where you reside once paternity has legally been established and it will be up to you as to whether or not you use that amount to pay down your mortgage.

This would depend very much on personal circumstances. Is he working? Are you working? The ages of your children and finally whether the loan/mortgage are in your name solely.

If both are in your name solely, then I am afraid other than maintenance he is not obliged to pay for the housing or loan. Actually he is not obliged to pay anything towards that, but he is obliged to pay for the living arrangements of his children and to enable them to live in the style they have become accustomed to.

A mutual agreement is much preferred than dragging both of you through the long process of taking him to court.

Good luck with this, getting money from a man who is unwilling is like getting blood from a stone.

if his name is on the mortgage then he is still obliged to pay half, even if he is not living in the house.
If the loan is in joint names, the same thing applies but if it is in your name only, then it is your responsibility.
Your ex should also be paying you maintenance for your child(ren) if he isnt, contact your nearest CSA office.

He only has to pay maintenance. You may be entitled to help with your mortgage if you are on a very low income though.
