To make a long story short, my hubby rec'd and injury at work that resulted in spinal fusion. He has an attorney , has been to a depostioin, has a mediation with the state workers comp rep and the lawyers involved next month ( this has been going on for 18 months now) His lawyer says things look very very good for his case, but informed him now is crutial and to be carefull what he does. He does hardly anything as the surgery was a few months ago, he can not bend, lift etc. However, the lawyer said make yourself sparse, do not even carry a bag of groceries ,even if the bag even contains a loaf of bread, because they could be watching. Is this true? Also, I have heard that they can watch you even after you obtain your settlement and request money back if they see you do something. My hubby is afraid to grab the garden hose and water the plants, he will sit in lawn chair and throw the dog a toy, after all he is disabled ,but not dead. How carefull does he have to be?

Well, his attorney is just being very cautious with it...I don't see the harm. Regarding your specific question, I think you should elaborate your concern with the doctor. Maybe he can provide some sort of written documentation as to what, and what not, your husband is capable of. Ask your attorney about it too though...make sure s/he knows your concerns.

Yep. My low-life brother-in-law claimed he injured his back 'on the job' and hired a fancy lawyer to get him a handsome settlement. He made the mistake of deciding to divorce his wife so that he wouldn't have to share the money with her. My sister-in-law put a 'bug in the ear' of the insurance company, who watched as her ex-husband worked on roofs, pushed cars out of snowdrifts, jumped on a trampoline, lifted weights, etc., etc.
The insurance company sued him for fraud and took back all the cash. -RKO- 06/17/07

Yes, they could be watching and you may not even see them. If there is a chance at a large settlement, there are most likely insurance "spies" out there to catch him in the act, trying to prove a fraud case. I hope your hubby recovers fully and soon!

yes they can watch, and their job is to do whatever they can to make it seem like you husband is a scammer. i would say that he should do whatever he can to get batter, but real;ize that they can take a film of a shopping bag with a loaf of bread and make it seem like a 50# bag. i have worked on both plaintiff and defense sides, and only in the defense side was it considered normal and okay to scew the truth, shred docs, lie, etc. so that's probably what your dealing with.

Yes. The insurance companies investigate but can't possibly watch everyone. They don't expect you to stop daily living but it's wise to make sure you don't do anything to further injure yourself. Your lawyer is right so heed his advice.
