I got divorced in NC two years ago and I was able to file after 1 year of being separated. If she left 3 years ago, you should be able to file for divorce. You can file if you have been living in North Carolina for at least 6 months.

If you want to petition the court to grant a no-fault divorce, you only need to be separated and living apart for a period of one year in order to get divorced.

It is a year!!! Do you know where she is? If so put a notice in her local paper asking for divorce. If she responds within a month .....great! If not you can still get a legal divorce without her because you gave notice....

One year but if you sleep with her during this time all bets are off, and the countdown starts again from zero.
