I got divorced in NC two years ago and I was able to file after 1 year of being separated. If she left 3 years ago, you should be able to file for divorce. You can file if you have been living in North Carolina for at least 6 months.

If you want to petition the court to grant a no-fault divorce, you only need to be separated and living apart for a period of one year in order to get divorced.

It is a year!!! Do you know where she is? If so put a notice in her local paper asking for divorce.If she responds within a month .....great! If not you can still get a legal divorce without her because you gave notice....

all you have to do is file with the magistrate and it costs like 15 bucks

Not sure about NC, but in Texas i think it a year.... You should be way past the time....
