To be married in the Catholic church you must have any and all previous marriages annulled.
Your future spouse must also have any and all previous marriages annulled.
You and your spouse must both be Catholic to be married in the Catholic Church.

You mean the man your married to now, you were married by a Justice of Peace and now both of you want to get married in the Catholic Church. Even if this is the same man you married by the Justice of the Peace, you would not be able to rigthfully marry in the Catholic Church because your husband is not a Catholic. You can't marry in the Catholic Church but if this is your first husband a Priest can marry you in a home of your choose and bless the marriage. But, in order for you to be married in the Catholic Church you are your husband cannot have never been married before and your husband would have to take the lesson and become baptized in the Catholic Church in order for you to be married in the Catholic Church and your children are suppose to all be Baptized as a Catholic. Otherwise you promise your children to the Catholic Church. This marriage by a Justice of the Peace if I'm not mistaken would have to be annulled in under for you to marry in a Catholic church. I'm not sure about the Annulment ., you'd need to talk to your Priest about this and explain to him how your marriage took place with a Justice of the Peace. He'll be real helpful and tell you about the annulment.

If you are a Catholic and married outside of the church, the marriage never happened as far as the church is concerned.

Once the legal divorce is over, you are free to remarry within the church.

if you want to marry again in the church you need to get an annullment from the first. the catholic church will not marry a divorced person.

The Catholic Church is strict. I suggest you talk with a priest.
