No. It isn't official without a court order. However, a parent can temporarily sign over custody to a grandparent if the parent is traveling. This would enable the grandparent to act "in loco parentis" if the child needs medical treatment.

Now for a correct answer.

Yes, they can. but it would be invalid and non-enforcable.

Only the court has jurisdiction over the child once a custody order has been issued. If the couple has such an order, any third-party agreement without court approval is invalid on its' face and non-enforcable.

It is also a strong reason for the court to take custody from the parent attempting such a move and award the child to the other parent.

They could sign over Temporary Guardianship papers and have it notarized but The Grandparents have the give the children back whenever the parents request it. The papers would give the Grandparents the right to have medical care administered to the child and they could register them in school etc.

i agree completely with the first answer, just have them give the funds back to you. as long as you are helping with clothes and etc you know your parents wouldnt mind and esp since they offered to help you guys out. it is probably your only option so that is just what i would do. a little insight to why they are probably doing this-- think child support if you and your husband were getting divorced or whatever whoever had the kid would end up having to pay child support. since the child is still your its just they have custody of him and stuff as the parents they are making you legally responsible to help take care of him. unless you are willing to let your parents adopt the child i think that is the only way around this and since its just temporary i dont think you guys are willing to go to those extremes. my grandparents adopted me leaving my parents with no responsibilty over me. when your child is adopted though you have absolutely no say what so ever in what happens with that child. but im thinking you and your parents will have to work something out because the state is doing what it thinks is fair and i dont think there is any way around it.

Ok i have one for you my sons live in girlfriend that they have lived together for about 5 years had a child but she walked out and left him but my son made her leave the Baby, and she never came back because she knew it would be detramental for him to be moving the Baby back and forth to home to home because he is Autistic well now i have him and he has been with me now for about 4 years, well my son has tryed to commit suicide has been in trouble with the Law for Drugs, and has Moved from home to home and has been Married 2 times he is on SSI so he does not work he can just Bearly afford Him self Must less a Handicapp child with much needed needs but any ways i would like to take Gaurdianship of Him His Mother Said she would give it to me Because she feels like he would be better off with me that her or my son so can she do witjust her consent or do i have to have both of them, even tho they was not even Married But i think his Name is on the Birth certificate But i think he has Maybe raised the Child may 6months to maybeeeee a year since she has been gone and he is 9 years old and she left when he was 2 so i really dont know who has legal custody of the Baby i really need some advise so i can make sure this baby can have no harm come to him and my son uses him as a tool so i will do what ever he wants me to do so i wont be scared he will come and take him Please Help we Live in OKLAHOMA

Yes they can but they have to get it notarized. All you have to do is sign over temporary custody to them it is as easy as writing it out and having it notarized. Also you can give them power of attorney over your self and this will help to. Most of the forms you need can be found at your local court house.

yeah...but it could turn messy when the parent wants the child back and the grandparent doesn't agree....
