My daughter has a friend that doesnt get along with her mother and is treated badly. She is 17 years old and has graduated from high school, we are willing to let her live with us but not sure if her mother can do anything to get her or us in trouble since she is under 18.

If she has tolerated things this long, then surely she can hold on until her 18th birthday. Then she can do as she likes. If things are totally intolerable, and for good reason, then she could file with the family court for emancipation from her mother.

I would suggest you listen to KP. I don't know if he / she is an attorney, but I am and that is the only correct answer that you have received.

At a minimum, you could be charged with interference with a parental relationship and harboring a runaway.

If you want to take this child in, either obtain an affidavit of guardianship from both parents and register it with the court, or petition the court for guardianship. It doesn't take that long and will expire on the child's 18th birthday.

If she leaves home without parental permission and you take her in, then of course you can get in trouble for it. She’s a minor and as a minor she is subject to the control and supervision of her parents, which means they get to decide where she lives.

The fact that she’s graduated from high school is irrelevant. Graduating from school is not an emancipating event. She’s still a minor.

She can leave home at 18.

She should contact a lawyer who specialises in family law to get a reliable answer. It can't hurt to ask.
