My husband and i have been renting for nearly a year we have 4 children, our tenancy is due to be over at the end of July, instead of renewing the tenancy the Landlord has served a Section 21 on us asking us to leave becuase a former tenant wants to move back in. Even though we have looked after the house and there are no rent arrears, he is still making me and my husband and 4 children homeless becuase he wants a previous tenant to move back in. Does anyone know my rights?

I know of NO state in which you can force a continued tenancy against the owner's wishes once your lease contract expires. Landlords are allowed to terminate tenancies at their own behest, even if you were a model tenant.

Sorry for your misfortune, but I recommend you start searching for other living arrangements as quickly as possible.

If your landlord is asking you to leave when your lease is up, then yes, he/she can make you move. You have no rights in this if the situation is that the lease is up and he wants you to move and has provided sufficient (most states say 30 days) written notice.

No need for a court order unless you're saying he's asking you to move prior to the lease expiration and rent is being paid in agreed manner. Sounds as if you'll be moving.

PS: You're not being evicted. Your lease is up. Your landlord has opted not to renew it, which is 100% legal.

Unfortunately the lease will probably say that both you or the landlord are required to give a certain amount of notice. And this could apply both ways. It makes no difference why he wants you out, he just does.
But I don't understand how he could evict you unless you are refusing to move, thus breaking the contract.

I had to add how disgusted I am re some people's attitudes towards you. I cannot believe how judgemental they are. I have moved too many times and quite understand your distress. It is hard to uproot your family, again, and it is expensive, too.

It really depends on what state you're in as to what the rules and regulations...rights for tenants and landlords.

I live in NY. And we went through something similar to this about 5 years ago. The landlord didn't want to rent to us, wanted to let her daughter move in. We were told that since we were at the end of the lease, it was up to the landlord if she wanted to renew the lease with us. Since she didn't, she had the right to ask us to leave.

I know this isn't what you want to hear, but unfortunately, stuff like this happens. I don't agree with it, but poop like this happens to good people. I'm sorry you're one of the good people this happens to.

You don't own the house. You have no rights unless your in an active contract to be leasing the property. For people saying its not fair, then landlords should be able to force tennants in staying in a property even after the lease is over..(doesn't make sense, right?)

Unfortunately Buffy, you will have to move eventually. Unless you have a lease for a specific period of time, you will be ousted sooner or later.
You will not be homeless, you have funds to pay rent there, and therefore you will have funds for alternate housing.
Start looking now for housing and when the time comes for you to move, you'll have a place to go to.
Be ahead of the game, and ahead of the sheriff...he will have no mercy on you, your kids and your possessions.

You have no rights. The landlord fulfilled his obligations under the contract, and he does not wish to extend. You get to move on. Sorry. Also sorry that others are being judgmental in the way that they answer you.

once the aggreement has run out, the landlord can therefore do what he wants with the property, hes not in breech of the contract unless he wants you out before your end date.

So once your contract date comes up, he doesnt have to renew it to you and therefore hes giving you the notice now to find somewhere.

when did your landlord go to court to get the eviction order? why weren't you there? you need to speak with a lawyer - specifically one who deals in landlord/tenant relations. also, call your state attorney general's office, they will have someone on staff who deals with problems like this, since each state has different laws, and someone's advice would be based on their experience, which might not be helpful for you.
