No, and it would be utterly ridiculous if a state ever enacted such a law. That would allow all first-time rapists, murders, etc to remain on the streets.

Absolutely NOT! The definition of a felony is 366 days in PRISON. It is NOT a felony if you do not spend at least that many days in prison.

I don't believe any law would take that away from a judge. I do know a statute determines if you are a felon, not the time in prison. YOU DON'T have to spend one day in prison to be a felon.
