Yes he can still visit...and at least he is doing something.
She should have help from them collecting in most states if the state is not helping for some reason there are private organizations that will help.

If she goes to court and is letting him see the baby without paing she will look like a saint, if she doesn't she can get in trouble.

You said she filed - but does she have an order yet? No order - no payment.
Visitation and child support are two seperate issues - a father cannot be prevented from visiting his child unless he is a threat. Being a deadbeat is not a threat.
Child support is an amount set by the court that is to be used in the day to day maintenance of the child. It is not a pay to play program where Dad's are paying for the privilege of seeing their child. Dad's have rights too!

If the visitation rights are in the divorce decree, then yes. He still has visitation rights and if she simply quits allowing him to see the child, then she is in violation. Two wrongs don't make a right. Visitation and Child Support are two seperate issues in the eyes of the court. She should seek legal means to collect back payment, such as having his wages garnished.
And to the guy up above who called his ex a bia-tch for having his wages garnished once a month...if you had been paying twice a month already, she would never have had to take those steps to begin with. I would say in this case, you're the bia-tch.

If the visitation is court ordered, she needs to allow it or she can be held in contempt of court. The other issue is the harm to the child. If the child is old enough to know dad is not coming around, it can cause some pretty bad self-esteem issues. The child should never be put in the middle like that. I wish your friend luck. It sounds like she'll need it.

by law unless he has a restraining order put on him yes he can see his kids.... sucks i know my mom went through the same thing with her ex-husband and my brothers.. even though he had a job it was under the table so the government couldn't attach his wages and he hid from the police and everyone else until both of my brothers were over 21 which at that point he didn't have to pay any more.... but my mom never saw a dime and that stupid Ba$terd still saw my brothers from time to time until my mom finally put the restraining order on him..... one of my brothers was a product of rape by him after their divorce....... so i wish your friend the best of luck in getting help supporting the children that he helped create!

I am not sure where you live but I know in the state of Pa if they are ordered to pay and don't they first try to attach their wages, if they don't have a job they take their liscense and if they still don't pay their butts are off to jail! Good Luck to her because I am sure its very hard!

the purpose of child support is to giv the single mom money to help support this child with such neccesties as food, water, and diapers. she needs to confront the baby daddy and tell him dat she shuld not let him see da baby until he start payin sum child support. since they not married she dont hav to let him see the baby, nd if needed u need to take him 2 court, dat wat my sister did. her baby daddy is way behinD! he owe like 10,000 dollars. so if u know ur friend baby daddy got a job den u definetly need to take him to court. or giv him one more chance to start payin child support or he goin to court

child support is to give support to the child for needed things, clothes, food, etc....the guy should be taken to court to have visitation rights taken away from him but obviously your friend doesnt mind that the isnt paying child support because she continues to let him see the child without paying such thing....

she can have his wages garnished by court order....my ex did from the very beginning then she bitched because I got paid once a month so she only got a check once a month....I told her that if she hadn't had my wages garnished she would have gotten a check from me 2 times a month.....
