I am currently living in Missouri and my daughters father lives in Illinois where our daughter was born. My daughter wants to attend college in California. According to Illinois law my daughter father will have to pay for her college expenses, California has no provisions. I need to know if since my daughter was born in Illinois and the child support order also took place there if Illinois law will apply to him paying for her college or if since she is attending college in California their laws will apply.

Illinois law will apply until Illinois loses continuing exclusive jurisdiction. As long as the father lives in Illinois, it WILL continue to have it. See uifsa.

The court that issued the child support decree will usually continue to have jurisdiction. Also, if you have to take her father to court, it's better that it be in the state he lives in, even though you'll need a lawyer that's licensed to practice in Illinois, because it's easier to get him served with papers ordering him to show up if the court ordering it is in the state he lives in.
