If you've been acquitted, they cannot try you again for the same offense, even with new evidence

Even with new evidence, the government cannot try you again for the same charge or for any charges that could have been brought the first time around. This would be a violation of the 5th Amendment's protection against Double Jeopardy. *Notice* that this does not apply to hung jurys or mistrials that were not caused by the government's actions--you *can* be retried if either of these are the case.

You don't get trial for murder, you get charged with murder.
They don't trial you, you go on trial again.

If the procecution has substantive new evidence ,he can file new muder charges, even if you were found not guilty the first time.

Using the old evidence, he can try you on a greater or lesser murder charge.
