The answer to how the media gets away with this is found in the U.S. Supreme Court case of NYTimes v. Sullivan. That case made it almost impossible to sue the media. To win a case against the media you have to prove the story was false; the media knew it was false; they published it with the specific intent to maliciously harm the person who is the subject of the story. The "malicious intent" element is almost impossible to prove. "Spin" is often a matter of opinion, so if it's phrased that way, it's protected speech under the First Amendment. So, those are the literal reasons. Your solution--that more people should speak out--is the only answer. For example, the young men accused in the infamous Duke rape case are considering lawsuits against the prosecutor (Nifong), the University and individual professors. Notice they have not announced any intent to sue any media outlets. I'm sure they've already been advised it's a waste of their money.

It is as much the fault of the people as it is the media. If we called and wrote the sponsors of the programing and insisted that they stop buying ads if the media would not stop the BS you would see a quick turn-around. But Americans are willing to swallow the BS as long as they can hear the latest gossip.

Because they got powerful backing. So if you are that little person, you would not be able to make yourself heard. Most people depend on the mass media. Who can get that close to any famous person if not the journalist ? Who can get right into the war zone if it is not the journalist ? Who knows how to get the sources if it is not the journalist ? So you have not much choice but to believe them.
