Next week I will attend a custody mediation ordered by the judge. I requested a modification in custody. I know for sure the my ex will not show up,what is going to happen if he doesnt? It would be contempt of court? I am in Pa. And what is going to happen to the custody case? Thank you for any answer!

If a party to a case does not appear in court, he will be declared in contempt and his absence is a waiver of right to be heard.

As bells told you, unless the parties were court ordered to mediation it will not be contempt of court.

I wish it were that easy. I have a friend who is going through the same process and her ex has not shown up to court-mandated mediation several times and they just keep pushing the date back for him. His lawyer can't even find him, he's been convicted of distributing meth, and they are still bending over backwards for him. This is in KY, so you may have a better court system in PA.

Good luck, I hope things go better for you!

You can only be held in contempt, if you were subpoenaed to court and don't show up. If he doesn't show up I would say that you may get want you want as a default.
