Hi,

the seller of the property I've been looking to purchase has backed out, literally, at the last hour.

I've spent a good whack on surveys, solicitors, and structural engineers, not to mention that I've sold my old house and gone into temporary accomadation.

Can I get any recompense out of him for this? I think I know the answer but wondered if there's anything I can do?

I take it you have exchanged contracts, this is a legally binding agreement, and I would suggest that you contact your solicitor regarding this. I understand that they can put a notice on the land registry which stops the seller of the property being able to sell/remortgage etc.

This is a very good question as it seems that this sort of thing is happening more and more. You might look at taking him to the small claims court but even that's doubtful - what does your solicitor say or have you already paid him too much money? I wish you the very best of luck and hope you find another better property.

That's awfull, I'm so sorry!! I'm afraid you do know the answer, unless you're in Scotland where I believe the law is different you can't do anything.

I would guess you can claim up to whatever the limit is in the Small Claims Court.
