I have twins that r 2 and their dad is pushing the issue for my now husband to adopt them in which due time he will but my question is that courts go by his income and other child support and he has 5 kids total that he was paying for and now 1 has had a kid and dropped out of school and he no longer has to pay for him will he have to split that money between the other four kids i would not push the issue but he has been bragging about how much money he has to blow now and gripeing bout the others

Why are you letting him get to you?? He's bragging about how much money he is going to have to blow now --- think about that - if he has 5 children- and he pays child support to all- how much money could this really have been?? I'd say- not much - he's an idiot- ignore him!!!
No, they will not split the reminder of the money with the other 4 children - even if you go back to court - it won't affect it. sorry.
As far as adopting -- I wouldn't do it - actually- I would - I would do it when your child is 17 1/2 yrs old - and the dad is very close to done paying : )

The biological father still has to pay child support and it would be confusing for your kids to be adopted out to a stepfather who may or may not stick around. Divorce is more common the second time around and it is at forty percent in Canada and sixty percent in the U.S. Does it sound like a good idea? Why should you get more if he is no longer supporting five kids but four as the money is for them and not for you?

Not typically. If the custodial parent does not seek an increase in child support, the set, said amount by the court for child support will remain the same until the child is 18.

Prior to 1995, there were no wage increase allowing for a custodial parent to seek more child support. Nay even for cost of living increase. I used to be impossible to get an increase, now due to inflation a custodial parent can seek an increase. Still it is very difficult to be awarded a higher amount.

From what I gather your ex doesn't love his kids.

To get to you question, it doesn't matter about his other children...it matters about yours. Of course his income.

Just from what you explained your ex is a real a s s!

Your now husband is going to adopt them?....is that what I understand?

Here's how that works....the courts do not care about your now husband income...they care about yours and your ex.

The main thing the courts look out for is the welfare of the children.

Not knowing the entire situation ie; your ex wants out of the support issue. Obviously you see the ex.

If you don't want your ex to go away then keep on him for the support...plain and simple. You go back to court then the judge will see it.

With you saying your ex brags about things then if you go back to court, he may just have his child support raised. They will look at the income ratios and also inflation.

If he pays on 5 and the one drops off the roster, no, he doen't split it between the others. Ignore his bragging and griping.

No they wont raise it or lower it unless you go back to court and request a change
