3 years and 9 months. He works 50 hours a week and he now this year gets 2 weeks paid vacation. is vacaton paid considered sick leave. the reason i am asking is because we are having to take one of his weeks for when the baby is born.(i know we could take unpaid leave but thats not an option)thanks. state is texas

Vacation is not considered the same as sick leave. Many companies across the country spell out that sick time is considered without pay time in your hire contract.

If he is taking time off because of baby, that would be considered paternity leave, not sick leave. Very few companies offer that! And if they're like every other employer who does offer sick leave, he'd need a doctor note for being off work. Short of passing out during the delivery and hitting his head to get that note, he's stuck taking vacation.. :)

If I'm not mistaken, the law is 50 hours a week = 50 hours of paid sick time. If it isn't, then you need to move to Canada. We get 1 year maternity leave (70% pay) and have the option of paternity leave instead/in combination with.

Yes, he can call in. Just explain that he and his whole family are really sick. Any normal boss would understand and let him have a day off. Also, any documentation would be of help -- such as a doctor's note. I once started a new job with other new hires. On the start day, one guy called in sick. The boss was compassionate and believed him and he started work the day after he was supposed to.

I dont know the laws in texas but I know in my state they arent required to give you vacation or sick leave. Its all on what the company offers.

If the company doesnt offer any other paid time off then I guess your only option would be like FMLA unpaid time off.

No sick leave & vacation are different. But if your husband speaks to his employers they will probably accept him using his vacation for the baby (after all they are required to give him time off) and this will eat up his vacation.

We did this when our son was born.

I'm shocked people are so uninformed about their rights if they get sick

There is very few places that grant sick leave. He is lucky to be getting two weeks paid vacation. any more the working person gets nothing except his pay day and they try to cheat him out of that..Sorry to sound negative but that's the way it is and it just keeps getting worse.

You can use vacation leave, as long as it is approved by the employer, for what ever you want..... If he is not offered sick leave at work than his only two options are unpaid leave or to use his vacation time.

No law says that sick leave has to be given as a benefit. You having a baby is not him being sick. Sick leave should be for people that are sick.

just go on a week vacation

ull probably get bored in 2 weeks plus with a little baby the summer might endanger his health

There is no law i'm aware of guaranteeing maternity or sick leave! You may want to talk to the human resources department at his company, to see if there is leave extended that you are not aware of!
