file a case? NO. getting pregnant by another man is not illegal. Granted, it's not a good thing, but you can divorce her & tell the judge she committed adultery.

Yes, go the court and file a paternity suit. They will contact the person in question and legally force him to come in for a DNA test when the baby is born. You dont have to do anything for the baby until you know that its yours, but you can on your own discretion.

Once the results are in, the court will identify who the father is. If its not yours, you are free from responsibility, if its yours, Congratulations!!!!!!!


If you stay with your wife and adopt the child, you will be known as the childs father,although not genetically. If you get a divorce later, you will stay have to pay childsupport because you adopted the child in which the law says that is your child as if it came from you, so you are still held responsible.

Actually, you can sue the father of the baby. Its an adultress situation and is in many states against the law. It has something to do with interference in a contractral marriage. Check on line and find out what your rights are. As far as your wife goes I would leave her and let him take over. Obviously she does'nt deserve you. Yes . It's called adultery. It is grounds for divorce. Along with habitual alcohol or drug abuse or physical abuse. (the only 3 reasons to file for divorce in the state of South Carolina). Without grounds for divorce you must be legally separated for 1 year before a judge will grant you a divorce.

Did she actually say this was another man's child? If you are still married at the time of conception, the courts will legally consider this to be your child unless you demand a paternity test after the birth to prove that it isn't. If you do not have this test, then you will be responsible for support of the child. Good luck to you.

depends on the state. If it is a no fault state, no...you cant do anything except divorce her. However in many states yes, get a paternity test and then file for adultery. Either way you should see a lawyer!

You have to do something before this child is born otherwise you might be obligated to pay her child support. Phone a lawyer referral line and they can give you free legal advice for 15 minutes.

If you choose to stay in that relationship however, some laws state that even when the child is not yours - you are still obligated to pay. My ex-husband is getting sued for 8 children that are not his, what goes around comes around in life.

I'd file a divorce case personally if I knew that my husband got another woman preggers, but that's just me.
