me and my wife are deciding to get separated but we dont plan on divorcing for a few years , i am about to buy a property in the state of Florida what can i do to protect my property in case she decided to fight me on day for it , she has told me that she has no problem signing a paper that states that she has no rights to the home i buy in Florida , is there a such paper that i am able to get for her to sign to protect myself

Better file for legal seperation and see a Lawyer.

Your on a slippery slope my friend. If you move and she files where you are you'll be making a trip back for the divorce, unless you file first, but you'll probably have to live in Fla. 90 days prior to filing.

As far as the Fla. property consult an atty. it's like $65.00 see if you should at least get legally separated before you buy anything.

Make a list of questions to ask the atty. after making the appt.
If you die while still married to her she will get the Fla. property

Safest Answer: Wait until the divorce is finalized.

Realize that regardless of if she signs a letter stating that she has no rights to the home does not determine that won't be seen as part of your settlement from the court.

Better be safe than sorry, wait until the divorce is final so it's not considered communal property.

Yes - that would be a "post-nup". If you have her sign a paper saying she has no grounds for future claims against her it would protect your property.

My advice would be to talk with a lawyer and he can get papers written up.

most people who "separate" do so in the hopes that they are able to work it out. sounds like you want a divorce no matter what why not just divorce her now. by property later on. by the way i don't believe in divorce in MOST cases

have a lawyer draw up an agreement that both of you sign. but i wouldn't really suggest buying property knowing your going to get divorced.

No.... I just got a divorce in FL and owned property BEFORE we got married... The house was in my name but I refinanced while we where married and they make you put your spouses name on the paperwork. If I had NOT put his name on the paperwork, I would've kept the house, because I purchased it before the marriage. My lawyer told me that any property aquired while married is marital property.... Talk to a lawyer dude... Seriously.... I've lost $60,000 in equity on my home due to this f*cker...

just divorce already then buy the property. if you are seperating, thats like the begining of the end anyway
