Generally you wait until your application is complete and your patent has been issued. Then, as long as you can show that the competitor knew you had a patent application in the works, you can sue him retroactively for any proceeds he made between the time you filed the application and the time the patent was issued. After you are issued the patent, the court can also set up an injunction to keep the competitor from producing any more product.
