Ok...I DO NOT agree that gay marriage should be illegal in the U.S., but I was chosen the topic in my class (I HAD NO CHOICE) and I have to explain why it should... So I need ideas. Why should gay marriage be illegal?!

As with you, I wouldn't mind if it was legal. However, I do think you can make arguments against it, without bringing in religion, because you shouldn't be bringing in religion for why we should make it illegal (although religion can put it in context).

First, State sanctioned marriage is not a fundamental Constitutional right.

Throughout history marriage has typically been associated with religion, and that's because it is often a central part of religion, and there is nothing the government can or can't do to dictate who the various religions can marry (e.g., many people get married by buddhist monks - most buddhists - and many states don't recognize those marriages, but that does not mean they aren't married, they are, but their marriage just hasn't been sanctioned by the state. Similarly, gays can get married in many faiths or traditions).

Second, it is true States are looked at closely when they create laws that treat certain people differently, but when it doesn't involve a fundamental right or a protected class the state typically only needs a "rational reason" for creating laws (must be rationally related to the law).

Now, whethe I agree with them or not, States do have many rational reasons for sanctioning marriage between a man and a woman, including: they believe children raised by both sexes turns out more well rounded, society contributing children (because they have the influence of both); that the States have an interest in encouraging procreation and the continuance of society; that States believe the relationships between a man and a woman are healthier (literally, health issues) and more stable. Now, having given those reasons, it must be noted that if they must only have a rational reason it isn't required of them to prove or give evidence to back up their reasoning (at least not Constitutionally).

There is obviously much more to this argument, and you'd have to do your research on Constitutional grounds (not enough time or space here). But, the main argument should be that we need to leave it up to the states to determine what's best for their people (and the people make the decisions by those they elect - unless you're in Massachusetts of course, then it's the courts making the decisions and the people don't have the right to vote on it).

Gay marriage is viewed as illegal for the following reasons.

1. How does government get their money?
a. Taxes

Both partners will have to pay taxes, but gay partners cannot procreate and bring more lives in this world that will pay taxes. If its a man/lady, the government views this as the way to go as more people can enter this earth and pay taxes.

I feel that gay marriage should be allowed.

Look at suicide, you are taking money away from the government, so the government is going to penalize you. I did this same paper in college when I was enrolled for my paralegal degree.

I consider you're focusing extra at the piece of paper and also you desire to be identified through the federal government. To me it's not approximately the piece of paper, I'd alternatively no longer have the piece of paper, considering to me marriage is among a person, ladies, and God all getting into right into a union with every different. The piece of paper is simply displaying that you're married to the federal government. No, I understand it would not quit gays from dwelling with or loving every different. You may have the piece of paper. But for those who consider that each one Christians do not such as you or are towards then you we (gays and Christians) have plenty to paintings on, considering no longer all hate you. You are a youngster of God similar to I am. Yes, we do pastime separation of church and state, however there's plenty of church inside the state.

You have a tough position to defend.

Some people would say marriage is a pact with god and that by definition can only be a man and woman. I have also heard a crazy one about how health insurance premiums would go up because the would qualify for spousal benefits.

Beyond that I really don't have any.

I think it is a ridiculous puritanical position, that has no place in modern culture. (Try telling our President that)

If you want lots of responses go to the religion section the Fundy Christians have plenty to say about it.

well,there is absoulutely no good reason as to why it should be illegal.every reason any christian can come up with can easily be beat. but if your trying to write a paper on it,i suggest you go to www.missionamerica.com , www.godhatesfags.com , or just find some of the links on the mission america website. they are the most homophobic websites known to man. try looking through a recent version of the new testament and use it as a biblical reference. but dont use any of the old copys of king james because it wont include as many references as the new testament.the new testament warps alot of info...i would know. i have a 50 year old king james version that doesnt speak about homosexuality in anywhere but levitticus as a sin.

Con: In the Holy Bible it says that homosexuality is wrong.
Pro/Con: Think what it would do to all of those "couples" filing their income taxes. Joint/Separate? Married. What would the effect be on the tax base (I'm not EVEN going to try and do the numbers...)
Con: It would add more burden to an already over burdened divorce court/family law system.

I really think it should be legal. It's absolutly ****** up. Constitutionaly it should be legal. But you can always say its aginst some people's morals. Or agaist christianity...try posting this in the gay/bi/lesbian/trans section. Lots of bigots there
